Letter: Timing of project up to developer

Your story "Riverfront plans show life," Jan. 29, fails to mention that the state Department of Environmental Conservation issued a permit in August 2011 for Phase I of the de Laet's Landing project in Rensselaer.

The developer initiated the environmental impact statement process in 2009 and did not submit an application until 2010. Under my tenure, DEC expedited this project and worked with the developer so the project can move forward. Once DEC grants a permit, the timing of the project rests with the developer.

The design of Phase II of the project, which, as described in the article, includes a marina, floating docks and a hotel/restaurants complex, has undergone changes over time as a result of the developer gaining better familiarity with the requirements of such development in a complex tidal estuary.

DEC has had productive discussions with the developer aimed at minimizing the impacts of this development, in conformance with the State Environmental Quality Review Act. DEC remains committed to working with the developer on a design concept that will accommodate the developer's objectives while protecting a sensitive aquatic environment.

Recently, DEC met with the developer to discuss beginning work on a proposed walkway, a portion of Phase II of the project, which is still in the design phase and thus not yet formally submitted by the developer for a permit. Because this portion of the project involves only upland areas, DEC allowed the construction to proceed. DEC looks forward to meeting with the developer on plans for Phase II when they are ready.
