The Times Union recently ran a story concerning criminal justice issues in Columbia County. Subsequently, an editorial appeared contending that I have refused to allow local judges the opportunity to reject plea bargains my assistant district attorneys and I have offered to defendants.
On the contrary, I have always recognized judicial independence.
All of my actions have been consistent with this critically important principle. As district attorney (now in my third, non-consecutive term), former county judge and public defender, I strongly believe and know that judges have the authority and obligation to exercise their independent discretion in deciding whether to accept or reject any proposal presented to them.
